A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §16-2I-11, relating to providing that health facilities that provide abortions shall not only be fined for violating explicit provisions of law, but also for taking any other actions which are not in accordance with the best practices of care as determined by the Department of Health and Human Resources.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §16-2I-11, to read as follows:
ARTICLE 2I. WOMEN'S RIGHT TO KNOW ACT.
§16-2I-11. Health clinics and facilities to be fined in certain circumstances.

Any health clinic or facility that performs abortions shall not only be fined for violating explicit provisions of any law or rule or regulation it may violate, but shall, additionally be fined for taking actions which are not in accordance with the best practices of care as determined by the Department of Health and Human Resources.
Nothing in this section may be construed or interpreted to condone, permit, allow or endorse any abortion.




NOTE: The purpose of this bill is to provide that health facilities that provide abortions shall not only be fined for violating explicit provisions of law, but also for taking any other actions which are not in accordance with the best practices of care as determined by the Department of Health and Human Resources.
